# Privacy Impact Assessments

> Run PIAs using Regentra's canonical PIA procedure template, the Risk Register for documented residual risk, and the Privacy controls dashboard for ongoing operations.

A Privacy Impact Assessment (PIA) — also called a Data Protection
Impact Assessment under GDPR — is the documented analysis of how a
processing activity affects data subjects, what mitigations are in
place, and what residual risk you accept. GDPR Article 35, the CCPA
Risk Assessment rule (operative 2026), and HIPAA's reasonable-
safeguard expectation all create circumstances in which a PIA is
mandatory.

Regentra supports the PIA lifecycle through three concrete
capabilities — the same pattern as the rest of the privacy program:

1. **A canonical Privacy Impact Assessment Procedure template** that
   operationalizes the analysis. Adopt it, adapt the threshold
   questionnaire and approval routing to your org, and use it as the
   binding runbook for every PIA.
2. **The Risk Register** at **Compliance → Risk Register** for
   recording the inherent and residual risk identified by each PIA,
   with treatment plans and owners.
3. **Policy templates** for the upstream policies a PIA depends on —
   the *Privacy Program Policy*, *Uses and Disclosures Policy*,
   *Minimum Necessary Policy*, and *Consent Management Policy*.

There is **no dedicated "PIA module" inside Regentra today** — the
analysis itself happens in the procedure document, and the residual
risk it identifies is tracked in the Risk Register. A first-class PIA
record type is on the roadmap; until it ships, this is the audit-
defensible path.

## The PIA procedure template

The **Privacy Impact Assessment Procedure** is one of the canonical
templates in Regentra's policy library. It is framework-neutral —
regulatory citations live on the version metadata — and covers:

* The threshold questionnaire (when a full PIA is required vs. when
  a low-risk attestation suffices)
* Processing-activity documentation: data sources, types, downstream
  flows, cross-border transfers, retention, legal basis
* Necessity and proportionality analysis
* Risk identification from the data subject's perspective
* Mitigation design — technical, organizational, and contractual
* Residual risk evaluation and the prior-consultation trigger under
  GDPR Article 36

## Running a PIA

The actual PIA happens *inside* the procedure document — your team
fills out a copy of the procedure's worksheet appendix for each
processing activity being assessed. Until the first-class PIA record
type ships, follow this pattern:

1. **Start a worksheet copy** — duplicate the procedure's analysis
   appendix in your document store (or as an internal Regentra
   policy with a `pia:` tag) and tie it to the processing activity
   name.
2. **Complete the threshold questionnaire** to determine whether a
   full PIA or a low-risk attestation is the right vehicle.
3. **Document the processing** — data sources, types, downstream
   flows, cross-border transfers, retention periods, legal basis.
4. **Identify risks from the data subject's perspective** — re-
   identification, discrimination/bias, autonomy, chilling effects,
   concrete harm, special populations (children, patients,
   employees).
5. **Design mitigations** — technical (encryption, de-identification),
   organizational (access controls, training), contractual (DPA
   clauses, processor SLAs).
6. **Open a Risk Register entry** — see below — with the inherent
   risk before mitigations and the residual risk after. Link the
   PIA worksheet from the risk's evidence field.
7. **Route for approval** under the procedure's approval chain.
8. **Set a re-assessment date** appropriate to the risk level (high
   risk: 12 months; medium: 24; low: 36).

## Tracking residual risk in the Risk Register

The [Risk Register](/risk-trust/risk-register) is the durable record
of every risk the PIA process surfaces. Use `category: PRIVACY` (or
`AI_EMERGING_TECH` for PIAs covering automated decision-making and
ML systems) so privacy-specific risks aggregate cleanly on the
register dashboard.

For each PIA, create at least one risk entry with:

* **Inherent likelihood × impact** scored on the 1–5 matrix before
  mitigations
* **Treatment plan** — the mitigations the PIA designed
* **Residual likelihood × impact** after the mitigations land
* **Owner** — typically the processing owner, with the Privacy
  Officer as backup
* **Evidence** — link the PIA worksheet, DPA, vendor questionnaire,
  ML fairness test results, and any consultation correspondence

If residual risk is **HIGH** on the matrix, GDPR Article 36 requires
prior consultation with your supervisory authority before processing
begins. The Risk Register's status field captures the consultation
state (`OPEN → IN_TREATMENT → CLOSED`).

## When a PIA is required

The procedure template's threshold questionnaire codifies the regimes;
the short version:

**Mandatory under GDPR Article 35** if processing involves:

* Automated decision-making with legal or similarly significant effect
* Systematic monitoring of a public area
* Large-scale processing of special-category data (health, biometric,
  racial/ethnic origin, political opinion, union membership, genetic
  data, sexual orientation)
* Matching or combining datasets at scale

**Mandatory under CCPA's Risk Assessment rule** (operative 2026) for
processing that presents heightened privacy risk — automated decision-
making, profiling for targeted advertising, large-scale processing of
sensitive personal information, behavioral advertising.

**Best practice** — conduct a PIA anytime you launch a new product,
add a vendor that processes personal data, or materially change data
practices, regardless of regime. The threshold-vs-full path on the
questionnaire keeps low-risk PIAs lightweight.
